Data We Collect
We collect data to operate, secure, support, maintain, and improve the Application and related business functions made available through it (together, the "Application Services"). Some data you provide directly, such as when you set up an account or ask for help. Other data is collected automatically while you use the Application, including device details, usage data, diagnostics, security events, and error reports.
Name and contact data
We may collect your first and last name, email address, phone number, employer or carrier affiliation, and similar contact data, and use it to contact you or share updates about Bison Transport Inc. or its affiliates, the Application, or the Application Services.
Credentials
We process passwords and related security details to sign you in, protect your account, and keep the App secure.
Usage Data
We collect information about how you use the Application and Application Services on your device (including which tools and commands you use, frequency, and duration), how the Application performs, and any problems encountered, to support use, troubleshooting, security, and improvement.
Location Information
The App collects precise location data from GPS, Wi-Fi, mobile location services, cell towers, and wireless networks ("Location Information"), including in the background during an active driving session, and uses it for dispatch, load tracking, route planning, and operational safety.
On a personal device, you may grant, change, limit, or withdraw Location Information permissions through your device settings or, where available, through the Application settings. Disabling Location Information or uninstalling the Application may stop some or all Application functions from working, including load tracking and dispatch visibility, and may prevent you from performing duties that depend on those functions. Asking Bison to deactivate your account must be done through Bison's standard access-management and Authorized User offboarding process and is subject to Bison's business, legal, compliance, audit, investigation, and recordkeeping needs. Disabling permissions or uninstalling the Application from a device does not by itself delete information already collected or retained under this Policy.
Content
We collect messages and communications you send or receive through the App (including text, feedback, questions, and metadata such as timestamps and recipients), which authorized dispatch, operations, safety, compliance, and support staff may access to operate the Application and Application Services, coordinate work, support safety and compliance, and resolve issues.
We collect and store files you upload or share through the App (such as bills of lading, proof-of-delivery photos, receipts, scans, and other load documents) on the device and our cloud servers for as long as our business relationship continues and any period required by law, and use them to operate the Application and Application Services, support load operations, and maintain business, compliance, audit, and recordkeeping records.
Health Permission
The App may ask for a permission the device labels as health-related (activity start/stop detection). Herd2Go is not a health app and does not use this permission for any health purpose; we use it only, and only if you opt in, to detect when driving starts and stops so the App can turn on and off automatically and save battery. You can turn it on or off anytime in the App or your personal device's permission settings.
App Permissions
The App may request the following device permissions. Required permissions are needed for the App to work; optional ones can be toggled anytime in your device or App settings. On a personal device, these permissions are user-controlled device settings. You may grant, change, or withdraw them through your device's standard controls, but the Application will operate only to the extent the permissions it needs are enabled, and Bison may restrict or end access to functions that depend on disabled permissions.
- Location (Required): Used to provide dispatch, load tracking, and route planning services.
- Notifications (Optional): Used to send load updates, dispatch messages, and service alerts. You can turn off push notifications in your personal device settings anytime.
- Camera / Photos / Files (Required for some features): Used to scan and upload load documents (such as bills of lading and proof of delivery) and to take photos needed for operations.
- Motion / Physical Activity (Required for some features): Used, only if you opt in, to detect when driving starts and stops so the App can turn on and off automatically.
How We Use Your Data
We use personal data only as the law allows, including to:
- Provide, operate, secure, and support the Application and Application Services, including running your in-Application work tasks and finding, preventing, and fixing problems.
- Support pick-up and delivery using data such as names and addresses, and share limited data with third parties that assist with those or similar tasks.
- Activate, maintain, secure, and update the Application and related software components, including communications with our servers for version control, security, and update delivery, using data such as device type, Application version, operating system, network information, device identifiers, and similar technical identifiers.
- Improve the Application and Application Services and plan new features, including using non-personal details (such as operating system, browser version, and device type) to understand usage, and your IP address to adjust Services for your location (for example, language).
- Send and tailor Application-related messages, including alerts in the Application or through other channels about changes to information, the Application, the Application Services, this Policy, or the Terms.
Employment and Carrier Engagement Use of Your Data
As the Application is a work tool made available to Authorized Users, which may include employees, contractors, third-party carriers and their personnel, and other persons authorized by Bison in connection with services provided to or on behalf of Bison, we also may use personal data for workforce, contractor, carrier-engagement, operational, fleet-management, compliance, and business purposes, including to:
- Manage the employment relationship or, for third-party carrier personnel, the carrier engagement and brokered-load relationship and assign, dispatch, schedule, route, and improve work, loads, and workflows;
- Verify trips, stops, deliveries, pickups, attendance, hours, and completed tasks, and manage performance, service levels, and adherence to Company policies and standards;
- Monitor safety, security, and compliance (including driving activity, in-app messages, and compliance with laws, rules, customer requirements, and Company policies), and provide related training, coaching, and development, including re-training after incidents or complaints;
- Receive, investigate, and respond to incidents, accidents, near-misses, customer complaints, cargo claims, harassment or misconduct reports, and suspected policy or legal violations, and support corrective action, discipline, grievances, dispute resolution, legal claims, legal process, regulatory inquiries, and law-enforcement requests;
- Support audits, insurance (including claims and underwriting), risk management, customer-compliance needs, payroll, pay, expenses, related tax and reporting, and maintenance of books, records, logs, and other documents required for legal, regulatory, customs, tax, insurance, and internal-control purposes.
Depending on your location and the activity, the Company relies, where required, on one or more of the following legal bases: performance of your employment contract or, for third-party carrier personnel, performance of the carrier, brokerage, or transportation services contract between the Company and your carrier; compliance with legal, regulatory, transport, and workplace-safety rules; our legitimate interests in running, managing, and improving our workforce, carrier network, services, and safety program; protecting the health and safety of employees, carrier personnel, customers, and the public; and your consent, where required. Use of the App on personally owned devices is optional and, for employees, is not required for continued employment; for third-party carrier personnel, use of the App is governed by the applicable carrier agreement.
How We Share Your Data
Bison Transport Inc. protects Authorized Users' information, including information relating to employees, contractors, third-party carriers and their personnel, and other persons authorized to use the Application, both online and offline.
We do not sell or rent your personal data. We do not use it for targeted advertising or cross-context behavioral advertising.
We may provide data to:
- Bison Transport Inc. affiliates inside and outside your country;
- Outside service providers performing tasks for us, inside or outside your country (with an appropriate legal framework for cross-border transfers where applicable), including cloud hosting and infrastructure, mapping and location services, communications and messaging tools, document scanning (such as Scanbot, which sends data to the Bison private cloud), analytics and crash reporting, and user support;
- Our authorized agents and representatives, inside or outside your country (with an appropriate legal framework for cross-border transfers); and
- Anyone we are legally required to share personal data with, when they make a valid and enforceable request.
We will also access, share, and retain personal data where we believe in good faith it is needed to comply with the law or valid legal requests (including from law enforcement or government agencies), or to run and protect the Services (including preventing attacks on our systems or networks).
Some parts of the Services may link to third-party services with different privacy practices; data you share with them is governed by their privacy statements, not this Policy, and Bison Transport Inc. is not responsible for their practices. Please review their policies.
Internal Access
Within the Company, only staff with a legitimate business need may access personal data collected through the App. Depending on the reason, authorized personnel may include:
- Dispatch, operations, fleet and network management, safety, security, and regulatory compliance;
- Driver and internal user support, human resources and personnel administration (for employees), carrier relations, vendor management, and brokerage operations (for third-party carrier personnel), and managers and supervisors responsible for the employees, carriers, or work involved;
- Legal, risk, claims, insurance, payroll, finance, accounting, internal audit, investigations, and ethics or compliance teams; and
- IT and information security staff who support the App and related systems.
Internal access is governed by Company policies, role-based access controls, confidentiality rules, and the law.
Work Activity Monitoring
As the App is a work tool, and to the extent the law allows, the App and related systems may be used to monitor, review, and record work-related activity, including:
- Precise location while you are actively driving or working (including start, stop, duration, and route), messages, chats, notes, and other App communications, and documents, photos, scans, and other files uploaded or opened through the App;
- Notifications, acknowledgments, confirmations, task or trip completions, and usage, device, network, diagnostic, performance, and error information about the App.
Monitoring supports workforce management, operations, safety, security, compliance, training, quality, investigations, dispute resolution, and related business needs.
You should not expect personal privacy in anything you say, send, or do through the App; do not use it for personal content you wish to keep private.
Devices
The App may be installed on a Company-issued device or, if allowed, a personal device used for work; third-party carrier personnel typically use devices owned by themselves or their carrier. If your access ends or is suspended, or if Bison reasonably requests it as part of security, compliance, investigation, or offboarding, you may be requested to stop using the Application, uninstall it from devices you control on which you installed it, and complete reasonable access-termination steps you are able to perform. This Policy applies to personal data and other information collected through the App and related Company systems regardless of device ownership, and does not give the Company a general right to access personal content on your device that is unrelated to the App.
In limited cases, and only where the law allows, authorized Company staff and service providers may access App data on your device, or interact with the App on your device, for reasons such as security, troubleshooting, investigations, compliance, legal process, audits, or recovering or protecting Company information.
If you do not want your personal device subject to these practices, use a Company-issued or Company-approved device where available, and do not install the App on your personal device.
Data Security & Handling
Herd2Go uses technology and procedures to keep personal data secure, whether held on paper, electronically, or both, and reviews and updates its approach to address business needs, new technology, and legal requirements.
Tell us immediately if you believe your account credentials or information you provided are no longer secure, so we can take steps to protect your personal data.
If we learn of a breach affecting your personal data, we will notify you as the law requires, and, where permitted, will send the notice to the email address on your account.
Storage & Transfers
Herd2Go may store and process personal data, and share it with third parties such as worldwide cloud hosts and suppliers, in your region, Canada, the United States, Mexico, or any other country where Bison Transport Inc., its affiliates, or contractors operate, to meet the needs of our business, workforce, and customers. We take steps to ensure that data is handled in accordance with this Policy and applicable law wherever stored or transferred.
Retention
Herd2Go retains personal data for as long as needed to operate the Application and Application Services, support the relevant employment, contractor, carrier, or other authorized relationship, and satisfy business, legal, compliance, audit, investigation, dispute-resolution, legal-hold, and recordkeeping needs. Some information must be kept for legally required periods (for example, statute-of-limitations periods). When no longer needed, personal data is deleted or anonymized. For clarity, disabling permissions, uninstalling the Application from a device, or asking Bison to deactivate an account does not by itself require immediate deletion of personal data where retention remains necessary or permitted under this Policy, the Terms, applicable Bison policies, or applicable law.
Employment and Carrier Engagement App data
Personal data from the App may be kept longer for employment-related, carrier-engagement-related, or other legitimate reasons, including personnel and employment records (for employees) and carrier qualification, onboarding, and engagement records (for third-party carrier personnel); payroll, pay, expenses, and related tax and reporting support (for employees) and brokerage, transportation services, settlement, and related tax and reporting records (for carriers); safety, security, and compliance records (including driver qualification, training, monitoring, and carrier-performance monitoring); incident, accident, near-miss, complaint, and cargo-claim records; investigation, discipline, corrective-action, carrier-disengagement, and dispute-resolution records; litigation holds and records needed to bring or defend legal claims; records needed for regulators, audits, inspections, and customer-compliance obligations; and other legal, regulatory, insurance, and internal-control recordkeeping needs.
Your Privacy Rights
Depending on where you live, you may have the right to see, correct, delete (unless we must keep it by law or contract), object to or limit certain uses of, and receive a copy in a common, structured format of the personal data we hold about you. Questions about disputes, governing law, and jurisdiction relating to the Application are addressed in the Herd2Go Terms and Conditions.
We respond to verified requests within the time the law allows and may need to confirm your identity first.
Employment and Carrier Engagement Context
The rights above apply to personal data collected through the App, subject to legal limits, conditions, and exceptions.
As the App is used for work, some rights — including access, correction, deletion, restriction, objection, portability, and withdrawal of consent — may be limited, delayed, or unavailable where the Company must or is allowed to continue using your personal data for reasons such as managing and enforcing the employment relationship or, for third-party carrier personnel, the carrier engagement and brokered-load relationship; following legal, regulatory, tax, transport, and workplace-safety rules; keeping the workplace and operations safe and secure; running investigations and supporting discipline, grievances, and dispute resolution; detecting, preventing, and responding to fraud, misuse, and security incidents; keeping records for audits, insurance, customer compliance, and internal controls; and bringing or defending legal claims.
If we cannot fully honor a request for these or other permitted reasons, we will respond as the law requires. This Policy is not intended to expand rights beyond what the law provides or to limit any rights that cannot lawfully be limited.
Children's Privacy
The App is not intended for anyone under 16, and we do not knowingly collect personal data from children. If we learn we collected such data without proper consent, we will promptly delete it. If you believe we collected data from a child in error, contact us at smacdonald@bisontransport.com.
Changes to This Policy
We may update this Privacy Policy to reflect changes in our practices, the Application, the Application Services, the Terms, or the law. For material changes, we will post a notice in the Application or notify you in another reasonable way before they take effect.
